The study examines the current state of legislation, case law, administrative guidelines and specific tender instructions concerning the criteria considered in a government officiated construction and infrastructure tenders – and specifically the importance and value of the price criteria. The study focuses mainly on three subjects; the inclusion of environmental protection standards when selecting the conqueror, the attitude towards problematic conquerors of previous tenders or participants who offer a meager price, and the relative weight of the price criteria in the criteria mix. The study addressed eight states with varying legal systems: The United States of America, Texas, Florida, the European Union, Great Britain, Germany, the Netherlands, and France.
